  • We do not guarantee that product or service quality will meet your expectations.
  • Our coffee products are freshly roasted and packaged to maintain quality. However, once delivered, proper storage is your responsibility. We recommend consuming ground coffee within 1 week and whole beans within 2–3 weeks of opening. Always store airtight and away from heat, light, and moisture.
  • Any brewing recommendations provided are suggestions only. Results may vary based on equipment, water quality, and other factors.
  • While we make efforts to identify potential allergens, you should review product packaging for the most accurate and up-to-date allergen information.
  • Product Usage and Safety: Coffee and related beverages are hot by nature and may cause burns if not handled properly. You acknowledge that you are responsible for the proper handling and consumption of our products after delivery. We are not liable for any injuries, including but not limited to burns, resulting from improper handling, preparation, or consumption of our products. You agree to exercise appropriate caution when preparing and consuming hot beverages made with our products.

SECTION 7 - COFFEE SUBSCRIPTION SERVICES

For our coffee subscription services:

  • Express Affirmative Consent: Before charging you for any coffee subscription with an automatic renewal feature, we will obtain your express affirmative consent to the subscription terms, including the automatic renewal terms.
  • Clear Disclosure: We will provide clear and conspicuous disclosure of:
    • The subscription terms
    • The recurring nature of the subscription
    • The length of the subscription term
    • The exact amount to be charged
    • The timing of charges
    • How to cancel the subscription
  • Cancellation Policy: You may cancel a subscription at any time by:
  • Retention Offers: If you request to cancel a subscription online, we may offer discounts or other promotions to retain you, but we will simultaneously display a "cancel" button in a prominent location. If you click the "cancel" button, we will promptly process your cancellation without obstruction or delay.
  • Price Changes: If the price of your existing subscription changes, we will provide clear and conspicuous notice of the change 7-30 days before it takes effect, including information on how to cancel.
  • Annual Reminder: For subscriptions that renew annually, we will send an annual reminder disclosing what is being renewed, the frequency and amount of the automatic charges, and how to cancel.

These subscription terms comply with California's auto-renewal law amendments effective July 1, 2025.

SECTION 8 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

  • We reserve the right to refuse any order.
  • You agree to provide current, complete, and accurate purchase and account information.
  • You are responsible for paying all taxes associated with your purchases. For orders shipped to California addresses, we collect California sales tax at the rate applicable to the area to which the product is shipped.

D/B/A COFFEE BOP, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
    • Your access to or use of or inability to access or use the Service
    • Any conduct or content of any third party on the Service
    • Any content obtained from the Service
    • Unauthorized access, use, or alteration of your transmissions or content
  • IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO COFFEE BOP IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).

SECTION 17 - INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Acid Bird, Inc. d/b/a COFFEE BOP, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

SECTION 18 - GOVERNING LAW AND DISPUTE RESOLUTION

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law.
  • Jurisdiction: Any legal action or proceeding relating to your access to or use of the Service or these Terms shall be instituted in the state or federal courts located in Los Angeles County, California. You agree to submit to the jurisdiction of, and agree that venue is proper in, these courts.
  • Arbitration: Any dispute arising from or relating to these Terms or the Service shall be resolved by final and binding arbitration in Los Angeles, California under the rules of the American Arbitration Association. The arbitration shall be conducted by a single arbitrator with substantial experience in resolving commercial contract disputes. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
  • Class Action Waiver: YOU AND ACID BIRD, INC. D/B/A COFFEE BOP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
  • Small Claims Court: Notwithstanding the foregoing, either party may bring an individual action in small claims court.

SECTION 19 - INTERNATIONAL SALES AND SHIPPING

  • International Orders: We accept orders from and ship to many countries worldwide. By placing an order for delivery outside the United States, you:
    • Agree to pay all applicable international shipping fees and duties
    • Acknowledge that shipping times may be longer than domestic orders
    • Accept that certain products may not be available for international shipping
  • Customs and Import Duties: When ordering from COFFEE BOP for delivery outside the United States, you may be subject to import duties and taxes, which are levied once the package reaches your country. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be.
  • Compliance with Local Laws: You are responsible for complying with all laws and regulations of the country in which you receive the products. COFFEE BOP is not responsible if you violate any law or regulation as a result of importing our products.
  • Currency Conversion: All transactions are processed in U.S. Dollars. While we may display approximate prices in other currencies for your convenience, the final charge will be in U.S. Dollars.

SECTION 20 - SEVERABILITY AND SURVIVAL

  • Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.
  • Survival: The provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

SECTION 21 - MODIFICATION OF TERMS

  • Updates to Terms: We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on this page with a new effective date.
  • Continued Use: Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.
  • Regular Review: You are expected to check this page periodically so that you are aware of any changes, as they are binding on you.

SECTION 22 - FORCE MAJEURE

We are not liable for delays or failure in performance due to events beyond our reasonable control, including but not limited to acts of God, pandemics, war, supply chain disruptions, labor shortages, or internet outages.

SECTION 23 - COMPLETE AGREEMENT

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, shall constitute the entire agreement between you and COFFEE BOP concerning the Service.

SECTION 24 - SMS/TEXT MESSAGING TERMS

By opting in, you consent to receive recurring automated marketing texts from Coffee Bop. Message and data rates may apply. Frequency varies. Text STOP to opt out or HELP for assistance. Data is handled in accordance with our Privacy Policy.
